There are legal and constitutional experts who believe “pre-emptive” pardons from presidents may not be valid. Let me go on record saying I think the Trump administration should test the theory using Dr. Anthony Fauci.
You will recall he was one of several people preemptively pardoned by Joe Biden in the waning hours of his failed presidency. But Fauci hadn’t been convicted of any crime, much less charged. So – the theory goes – the ‘preemptive pardon’ should not be a thing because pardons are supposed to only be used to absolve someone of a criminal conviction.
If premptive pardons were successfully challenged before the Supreme Court, where such a challenge would ultimately wind up, then Fauci and the others would then be subjected to being charged for alleged crimes. And Fauci has a ton of them he should be answering for over his ties to the COVID-19 pandemic.
The man who spent four years assuring America the COVID vaccines were safe and effective apparently experienced one of their known adverse events himself — got the best private medical care the country offers — and continued publicly insisting such reactions weren’t happening.
RFK Jr. revealed the details on Fox News Monday night, drawing from Rand Paul’s release of Fauci’s personal diary entries. In January 2021, Fauci received his COVID vaccine at a very public press conference — cameras rolling, sleeves rolled up, setting the example for a reluctant nation. Kimmel has interviewed political candidates for more than 20 years — including Donald Trump himself, twice. But now that Trump controls the executive branch, Kimmel says: “[Trump's] FCC has threatened me, threatened our show, threatened our network, ABC, our affiliates, our local stations, based on simple, traditional, editorial decisions, guest bookings, it would seem they don't like.”
That should terrify every American who gives a damn about the First Amendment.
Kimmel says that, to protect ABC affiliates — particularly stations in Texas that would “have to deal with this nonsense” — the Talarico interview will not be broadcast on television at all. Instead, Americans who want to hear from a candidate for the United States Senate will have to watch it on YouTube.
And then Kimmel delivered the line that should set off alarm bells across this country: “And thank goodness, we have [YouTube] because in the America we live in right now, that is the best that we can do, until November, of course.”
This is censorship through government intimidation.
And the hypocrisy is staggering. As Kimmel pointed out, Trump happily appeared on his show while running for president in 2015 and returned again in 2016.
When Trump benefited from television hosts interviewing candidates, apparently there was no problem. Now that a Democrat challenging Republicans for a Senate seat is getting airtime, Trump’s FCC is pressuring ABC to pull the plug.
That is profoundly un-American.
No president — Republican or Democrat — should be allowed to weaponize federal regulatory power to frighten television stations over their editorial decisions or political guests.
Trump does not own ABC. He does not own America’s airwaves. And he sure as hell does not get to decide which political candidates the American people are allowed to hear from.
The First Amendment belongs to the American people — not Donald Trump. Shame on Trump's FCC for pressuring ABC to cut the Talarico interview, and shame on ABC for caving to pressure...
