Chapter 5: The Legal Avalanche
From the bank, I drove straight to the offices of Marcus Thorne, a ruthless financial litigator who specialized in trust and estate fraud. I handed him the folder of evidence. Marcus reviewed the 529 documents, the transfer logs, and the text messages. When he looked up, he was actually smiling.
“They really put it in writing,” Marcus chuckled, adjusting his glasses. “Claire, this isn't just a civil matter. A 529 plan is a tax-advantaged vehicle. By withdrawing $73,000 for a non-qualified beneficiary without declaring it, your mother has triggered a massive IRS penalty. Furthermore, wiring it across state lines to your sister's account constitutes federal wire fraud.”
“I want the money back,” I said. “And I want them to bleed.” “Oh, they will,” Marcus said. “I am filing an emergency injunction to freeze your sister’s bank accounts where the money was deposited. She won't be able to buy a pack of gum, let alone pay tuition. Then, we file the civil suit against your parents for breach of fiduciary duty. And finally, we send a copy of everything to the IRS.” “How fast can you move?” I asked. Marcus looked at his watch. “The bank freeze will hit Sabrina’s account by tomorrow morning. The avalanche starts now.”
